Terms & Conditions — Garage Car Lifts UK

Effective date: October 2025

These Terms & Conditions (“Terms”) govern the sale of goods by Garage Car Lifts UK (a trading style of Garage Equipment Online) to you (the “Buyer”). By placing an order, you accept these Terms in full.

1. Definitions

  • Buyer: the person or business purchasing goods.

  • Goods: products, parts, or equipment sold under these Terms.

  • Seller: Garage Car Lifts UK / Garage Equipment Online (acting as the contracting entity).

  • Intellectual Property Rights: patents, designs, trademarks, copyrights, know-how, etc.

2. Application & Variations

  • These Terms apply to all sales of Goods, to the exclusion of any other terms you may propose, unless expressly agreed in writing.

  • Any variation to these Terms must be agreed in writing by a director of the Seller.

3. Price & Payment

  • The price is either the published price or agreed discount, excluding VAT and delivery costs (unless stated).

  • Payment must be made via approved methods before dispatch (unless otherwise agreed).

  • Late payment: interest at 8% per annum above the Bank of England base rate may be charged daily.

4. Description & Samples

  • Descriptions are for identification only and do not constitute a sale by description.

  • If Goods are supplied by sample, slight variations in bulk goods (colour, size) are allowed.

5. Delivery

  • Delivery is to the address specified by you.

  • You must make proper arrangements to receive the Goods (e.g. unloading facilities).

  • Any damage, shortages, or duplicates must be reported within 14 days of receipt.

  • If delivery fails due to your actions, we may store the Goods and you will incur storage charges.

6. Refunds & Returns

  • You must notify us within 10 working days of order for refund claims, and return the Goods within 15 days in the same condition as sent.

  • Returns must be pre-authorised by us.

  • Restocking fee may apply on non-damaged returns.

  • We will not refund goods that are damaged by you, or bought knowingly “for parts/spares.”

  • Refunds are made via the original payment method or as store credit, as agreed.

7. Risk & Title

  • Risk in the Goods passes to you upon delivery or collection.

  • Title (ownership) remains with us until full payment of price and all other sums owed is received.

8. Warranty & Guarantee

  • Standard warranty: 12 months parts only, unless otherwise stated.

  • Warranty parts require up-to-date service records (e.g. 6–12 monthly maintenance).

  • Onsite warranty work is only included if specified in writing at time of sale.

9. Limitation of Liability

  • Our liability is limited to the contract price of the Goods.

  • We exclude all indirect losses, except for death or personal injury caused by our negligence.

  • Nothing in these Terms excludes liability that cannot legally be excluded.

10. Intellectual Property

  • All IP rights arising from performance remain ours.

  • You will cooperate (e.g. sign documents) to transfer rights where needed.

11. Force Majeure

  • We are not liable for delays beyond reasonable control (e.g. natural disaster, strikes, supply failure).

  • If delay is excessive, we may terminate the contract without liability.

12. Assignment & Subcontracting

  • You may not assign or transfer the contract without our written consent.

  • We may subcontract obligations, but remain liable for them.

13. Waiver & Severability

  • Failure to enforce a term is not a waiver.

  • If a term is invalid or unenforceable, it will be severed; the remainder stays in effect.

14. Governing Law & Jurisdiction

  • These Terms are governed by the laws of England.

  • Any disputes shall be resolved in the English courts.
